Terms and Conditions – Equestricare Products

Equestricare Pty Ltd (ACN 165 544 089) (we, us) sell equine therapy products via our online stores at
www.equinetherapyproducts.com.au and www.horsemassagecourse.com.au

These Terms and Conditions (Terms) apply to any purchases of physical products and eBooks (Product) made on our website.
By purchasing any Product from us, you agree to be bound by these Terms, together with our Website Terms of Use and Privacy Policy.

1. Product types

(a) Physical Products
Items shipped to your nominated delivery address, including tools, equipment and other physical goods.

(b) eBooks
Instantly downloadable eBooks delivered electronically for personal use only.

(c) These Terms do not apply to purchases of Online Courses and Short Modules or Certificate Courses, which are governed by separate terms.

2. Orders

(a) Please check your order carefully before submitting it. Orders cannot be changed or cancelled once processed.

(b) We reserve the right to cancel or refuse any order for any reason, including suspected fraud, pricing errors or stock availability.
If this occurs, we will notify you by email and issue a full refund (including delivery costs) if payment has already been taken.

(c) Product descriptions are provided on our website. Images are for illustrative purposes only and actual products or packaging may vary slightly.

3. Prices and payment

(a) Prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated. Delivery fees are excluded.

(b) Prices and delivery fees may change at any time but will not affect confirmed orders unless there has been a pricing error.

(c) Full payment is required at the time of purchase.

(d) Payment methods include credit card, debit card, Afterpay, Google Pay, Apple Pay and PayPal.
Payments are processed securely via third-party providers including Stripe and PayPal.

(e) International customers are responsible for applicable taxes, bank fees, currency conversion costs, customs duties or import charges.

4. Shipping and delivery

(a) Delivery options and fees are shown at checkout.

(b) Orders are delivered to the address provided at checkout. Please ensure your details are correct.

(c) Physical Products are generally dispatched within 1–3 business days.

(d) Delivery times vary by location and shipping method. Tracking details will be provided once dispatched.
We are not responsible for delays outside our control, including courier delays, customs or weather events.

(e) Title passes to you once payment is received. Risk passes to you upon dispatch.

5. Refunds, returns and consumer guarantees

(a) We do not accept change-of-mind returns or exchanges.

(b) If you receive the wrong item, please email info@equinetherapyproducts.com.au within 7 days of delivery
with proof of purchase and photos. We will arrange a replacement or a refund if the correct item is unavailable.

(c) Our goods come with guarantees under the Australian Consumer Law.

(d) If you believe a product is faulty, contact us as soon as possible with supporting evidence.

(e) Refunds, repairs or replacements may be refused where:

• the product has been misused or improperly stored
• care instructions were not followed
• damage is due to normal wear and tear

(f) Faulty goods may need to be inspected. If an item is found not to be faulty, return shipping costs may apply.

6. Equine Therapy Products Warranty (select products only)

(a) A 12-month limited warranty applies to Equine Therapy Products branded items only.

(b) The warranty applies to the original purchaser and is not transferable.

(c) The warranty does not cover:

• normal wear and tear or cosmetic damage
• misuse, neglect or incorrect handling
• bending, twisting, over-tightening or stepping on products
• damage to coatings, cables or Velcro
• unauthorised repairs or modifications

(d) Specific product care requirements apply, including proper charging and storage of battery-operated products
and correct handling of LED and infrared components.

(e) Warranty claims require proof of purchase and may require inspection.

(f) Misuse or excluded damage is not covered and return costs may apply.

(g) This warranty is in addition to your rights under the Australian Consumer Law.

(h) Some products may include a separate manufacturer’s warranty.

7. eBooks – access, use and refunds

(a) eBooks are provided via download links available for a limited time. Please download and back up promptly.

(b) All intellectual property rights remain with us or the author.

(c) You receive a non-transferable, non-exclusive licence for personal, non-commercial use only.

(d) Refunds are not offered for digital products unless required by law.

8. Liability and indemnity

(a) Nothing in these Terms excludes rights under the Australian Consumer Law.

(b) To the maximum extent permitted by law, we are not liable for indirect or consequential loss.

(c) Where liability cannot be excluded, it is limited to a refund or replacement of the Product.

(d) You indemnify us against losses arising from your breach of these Terms or misuse of Products.

9. General

(a) Use of our website is governed by our Terms of Use.

(b) Data handling is governed by our Privacy Policy.

(c) Any invalid provision is severed without affecting the remainder.

(d) These Terms are governed by the laws of Western Australia.
